این نوع از نفقه به بستگان سببی و نسبی و رضاعی تعلق می‌گیرد و شامل فرزندان، نوه‌ها، پدر و مادر و اجداد است. مرد موظف است نفقه همسر و فرزند خود را پرداخت کند اما پرداخت نفقه خویشان و فرزندان مانند نفقه همسر الزامی نیست و با توجه به تمکن مرد و شرایط معین می‌شود.

باید بدانید در عقد موقت نفقه برگردن مرد نیست مگر اینکه در زمان عقد میان طرفین شرط شده باشد. در این حالت مرد موظف است نفقه خانم را پرداخت کند.

حق حبس یک حق شرعی و قانونی برای دختران باکره است که براساس آن می‌توانند در دوران عقد هیچ رابطه جنسی‌ای با شوهر نداشته باشند. به این ترتیب که آقایی که به خانم خود نفقه نمی‌دهد، اگر پیش از این با خانم رابطه جنسی نداشته خانم می‌تواند از حق حبس استفاده کند و درخواست دریافت کلیه حقوق خود مانند مهریه و نفقه را در قبال تمکین داشته باشد. در این حالت مرد موظف به پرداخت خواسته همسر می‌باشد.

براساس قوانین اسلام فرزندان متولد شده نسبت به والدین خود حقوقی دارند که واجب است پدر و مادر آن را عمل کنند. یکی از این حقوق نفقه و خرجی زندگی فرزندان است.

ماده 1190 قانون مدنی پرداخت نفقه را بر عهده پدر می‌داند:

ممکن است پدر یا جد پدری به کسی که به سمت وصایت معین کرده اختیار تعیین وصی بعد فوت خود را برای مولی‌علیه بدهد.

بنابراین پدر وظیفه دارد به فرزندان تحت سرپرستی خود یا مادرش یا هر فرد دیگری که در سرپرستی او است نفقه بپردازد. چنانچه پدری توانایی مالی داشته باشد اما از پرداخت نفقه فرزندان و همسر خود خودداری کند، خانم می‌تواند به نمایندگی از فرزندان از یک وکیل نفقه در مشهد کمک بگیرد تا حقوق قانونی خود را به دست آورد.

نفقه جاریه: نفقه‌ای(alimony) که در شرایط جاری به خانم تعلق می‌گیرد مثلاً نفقه ماه جاری هزینه‌های زندگی خانم در ماه جاری می‌باشد. البته باید بدانید نفقه فقط پول نقد نیست بلکه هزینه لوازم آسایش و رفاه خانم می‌باشد و شامل خوراک، پوشاک و مسکن و… می‌باشد. میزان این نفقه با توجه به شرایط و براساس موقعیت فرد معین می‌شود.

میزان نفقه فرزند توسط کارشناس مسئول پرونده و با توجه به سن فرزند، نیازهای او و شرایط اجتماعی تعیین می‌کند. کارشناس پرونده با بررسی کردن شرایط زندگی خانوادگی و با توجه به مدارک ارائه شده از سوی مادر طفل میزان هزینه نفقه فرزند را مشخص می‌کند. نفقه شامل مواردی مانند هزینه خوراک، پوشاک، مسکن و تفریحات کودک می‌باشد.
